We at Bethphage are concerned about the impact of the Supreme Court ruling on Tuesday regarding the removal of the “Cheshire West Framework.” This relates to the legal safeguards required if someone lacks mental capacity to consent to their care and living arrangements and is under continuous supervision and control.
We are awaiting further guidance from the DoLS teams and assessors to work through what this means in practice. We will work with Care Provider Forums like PIC and Care England to understand the changes. In the meantime, we will continue to apply best practice in relation to the Mental Capacity Act, ensuring the rights, safety and wellbeing of the people we support remain at the centre of our approach.
